OVERVIEW

Welcome to OPULENTUM! The terms "we", "us" and "our" refer to OPULENTUM. OPULENTUM operates this store and website to offer you, the customer, a curated shopping experience (the "Services"). OPULENTUM is powered by Shopify.

These Terms and Conditions, together with any policies referenced herein, describe your rights and responsibilities when using the Services. Please read them carefully, as they contain important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use or access our Services.

SECTION 1 — ACCESS AND ACCOUNT

By accepting these Terms, you confirm that you are of legal age in your country or region of residence. You are responsible for maintaining the security of your account credentials and all activities carried out under your account. You may not transfer, sell, assign or licence your account to any third party.

SECTION 2 — OUR PRODUCTS AND DIGITAL SERVICES

We have made every effort to accurately represent our products online. However, colours and appearance of physical products (posters, mugs, bottles and accessories) may differ from what appears on screen due to device and display settings.

Our Services include the sale of physical goods produced on demand (Print on Demand) and the supply of digital content not provided on a tangible medium (wallpapers and digital backgrounds).

All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product at any time.

SECTION 3 — ORDERS AND WITHDRAWAL POLICY (PRINT ON DEMAND AND DIGITAL)

When you place an order, you are submitting a purchase offer. OPULENTUM reserves the right to accept or reject any order at its sole discretion. Payment must be received and processed before the order is accepted.

IMPORTANT — RIGHT OF WITHDRAWAL: In accordance with Article 59(c) and (o) of the EU Consumer Rights Directive, the 14-day right of withdrawal does not apply to:

1. Goods made to order or clearly personalised (all our Print on Demand physical products: printed posters, mugs, bottles and accessories).
2. Digital content not supplied on a tangible medium (wallpapers and downloadable files), once execution has begun with your explicit consent — i.e. at the moment the download link is sent or the file is delivered.

Replacements and Refunds for Damaged or Lost Items: A free replacement or refund will be issued exclusively in cases of confirmed carrier loss or items arriving damaged or defective (e.g. chipped mugs, creased posters or visible print defects). To request a replacement, you must send clear photographic evidence of the defective product and its packaging via WhatsApp to +39 375.7786411 or by email to opulentum.world@gmail.com within 14 days of delivery.

SECTION 4 — PRICING AND BILLING

Prices, discounts and promotions are subject to change without notice. Unless otherwise stated, published prices do not include shipping costs or any customs duties for international shipments, which will be calculated and shown before checkout.

You agree to provide accurate, complete and up-to-date purchase, payment and account information. You confirm that you are duly authorised to use your chosen payment method (including credit cards, digital wallets or instalment services such as Klarna).

SECTION 5 — SHIPPING AND DELIVERY

Our physical products are produced and shipped through Print on Demand partner services. Delivery times shown on the website are estimates only. We are not responsible for delays caused by shipping carriers, customs procedures or force majeure events beyond our control.

In accordance with Article 63 of the EU Consumer Rights Directive, risk of loss passes to the consumer upon physical delivery of the goods, not upon handover to the carrier. We commit to reshipping the order at no cost in the event of confirmed carrier loss.

SECTION 6 — INTELLECTUAL PROPERTY

All content on our Services — including the OPULENTUM brand, texts, graphic designs, poster artworks, digital wallpapers, videos and site layout — is the exclusive property of OPULENTUM or its licensors and is protected by Italian, European and international copyright and intellectual property laws.

Purchasing a digital wallpaper or physical poster grants a strictly personal, non-commercial licence. Reproducing, duplicating, reselling, distributing, modifying or commercially exploiting our designs or digital files without prior written consent is strictly prohibited.

SECTION 7 — OPTIONAL TOOLS AND PAYMENT PLATFORMS

You may be provided access to third-party tools integrated into the site (such as Shopify Payments and Klarna). We provide access to such tools "as is", governed by their respective third-party terms of use.

SECTION 8 — THIRD-PARTY LINKS

Our Services may contain links to external platforms (including our official social channels). We are not responsible for the content or accuracy of third-party websites.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

OPULENTUM is hosted on the Shopify e-commerce platform. All sales are made directly and exclusively with OPULENTUM. Shopify is not responsible for any aspect of the sales or products.

SECTION 10 — PRIVACY POLICY

All personal data collected through the Services is processed in accordance with our Privacy Policy, drafted in compliance with EU GDPR.

SECTION 11 — USER FEEDBACK AND REVIEWS

By submitting reviews, ideas or suggestions, you grant us the right to use, publish and display such content for promotional or commercial purposes. You confirm that your content does not infringe third-party rights or contain offensive or unlawful material.

SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS

We reserve the right to correct typographical errors, inaccuracies or omissions regarding product descriptions, prices, promotions or availability, and to modify, update or cancel orders at any time without notice, with a full refund of any amount paid.

SECTION 13 — PROHIBITED USES

In addition to other prohibitions set out in these Terms, you may not use the site or its content: (a) for unlawful purposes; (b) to violate local, national or international laws; (c) to infringe our intellectual property rights; (d) to submit false or misleading information; (e) to upload viruses or malicious code; (f) to collect other users' personal data; (g) for scraping, automated data extraction or use of AI systems to copy OPULENTUM's catalogues and designs. Violations result in immediate termination of services and account revocation.

SECTION 14 — AUTOMATED AGENTS

Access to the site via automated software, bots or agents must be clearly identifiable and must not circumvent security systems (CAPTCHA) or overload the store's infrastructure.

SECTION 15 — TERMINATION

These Terms remain in effect until terminated by you or us. You may terminate at any time by notifying us that you no longer wish to use our Services.

SECTION 16 — DISCLAIMER OF WARRANTIES

Subject to the statutory rights guaranteed to consumers under applicable law (including legal conformity guarantees on physical products), we do not guarantee that use of the Services will be uninterrupted, timely or error-free.

SECTION 17 — LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, OPULENTUM shall not be liable for indirect, incidental or consequential damages arising from the use of or inability to use the Services, or from delays caused by third-party shipping carriers.

SECTION 18 — INDEMNIFICATION

You agree to indemnify, defend and hold harmless OPULENTUM from any claims or demands made by third parties due to your violation of these Terms.

SECTION 19 — SEVERABILITY

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be enforceable to the maximum extent permitted by law, and the unenforceable part shall be severed without affecting the validity of the remaining provisions.

SECTION 20 — ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and OPULENTUM and govern your use of the Services, superseding any prior agreements.

SECTION 21 — ASSIGNMENT

We reserve the right to transfer or assign our rights and obligations under these Terms without restriction or notice.

SECTION 22 — GOVERNING LAW AND JURISDICTION

These Terms and purchase contracts are governed by Italian law. For any dispute arising from these Terms, if the customer acts as a Consumer, the mandatory jurisdiction shall be the court of the consumer's place of residence or domicile.

SECTION 23 — HEADINGS

Section headings are for convenience only and do not limit the interpretation of these Terms.

SECTION 24 — CHANGES TO TERMS

We reserve the right to update or modify these Terms by posting changes on the site. Continued use of the store constitutes acceptance of the updated Terms.

Abbiamo compiuto ogni sforzo per rappresentare accuratamente i nostri prodotti online. I colori e l'aspetto dei prodotti fisici possono differire da come appaiono sullo schermo. I nostri Servizi includono la vendita di beni fisici Print on Demand e di contenuti digitali (wallpaper e sfondi). Tutte le descrizioni sono soggette a modifica senza preavviso.

SEZIONE 3 — ORDINI E POLITICA DI RECESSO

Quando effettui un ordine presenti un'offerta di acquisto. OPULENTUM si riserva il diritto di accettarla o rifiutarla.

IMPORTANTE — DIRITTO DI RECESSO: Ai sensi dell'art. 59, lett. c) e o) del Codice del Consumo, il diritto di recesso è escluso per:

1. Beni confezionati su misura o chiaramente personalizzati (tutti i prodotti fisici Print on Demand).
2. Contenuto digitale su supporto non materiale (wallpaper e file scaricabili), dal momento in cui inizia l'esecuzione con il tuo consenso esplicito.

Sostituzioni e Rimborsi: Gratuiti esclusivamente in caso di smarrimento accertato dal vettore o di merce arrivata danneggiata/difettosa, con prova fotografica entro 14 giorni dalla consegna, inviata via WhatsApp al 375.7786411 o email a opulentum.world@gmail.com.

SEZIONE 4 — PREZZI E FATTURAZIONE

I prezzi sono soggetti a modifica senza preavviso. I prezzi pubblicati non includono spese di spedizione o dazi doganali, che saranno mostrati prima del checkout. Dichiari di essere autorizzato a utilizzare il metodo di pagamento scelto.

SEZIONE 5 — SPEDIZIONE E CONSEGNA

I prodotti fisici sono realizzati e spediti tramite partner Print on Demand. I tempi di consegna sono puramente indicativi. Non siamo responsabili per ritardi causati da corrieri, dogane o eventi di forza maggiore.

Ai sensi dell'art. 63 del Codice del Consumo, il rischio di perdita passa al consumatore al momento della consegna fisica dei beni, non al momento dell'affidamento al corriere. Ci impegniamo a rispedire l'ordine in caso di smarrimento accertato da parte del vettore.

SEZIONE 6 — PROPRIETÀ INTELLETTUALE

Tutti i contenuti dei Servizi (marchio OPULENTUM, testi, design, opere d'arte, wallpaper, video e layout) sono di proprietà esclusiva di OPULENTUM e protetti dalle leggi sul diritto d'autore. L'acquisto concede una licenza d'uso personale e non commerciale. È vietato riprodurre, rivendere o sfruttare commercialmente i nostri design senza previo consenso scritto.

SEZIONE 7 — STRUMENTI DI TERZE PARTI

Strumenti di terze parti integrati nel sito (Shopify Payments, Klarna) sono forniti "così come sono" e regolati dai rispettivi termini d'uso.

SEZIONE 8 — LINK DI TERZE PARTI

Non siamo responsabili del contenuto di siti web di terze parti collegati ai nostri Servizi.

SEZIONE 9 — RAPPORTO CON SHOPIFY

Tutte le vendite avvengono direttamente con OPULENTUM. Shopify non è responsabile per alcun aspetto delle vendite o dei prodotti.

SEZIONE 11 — FEEDBACK E RECENSIONI

Inviando recensioni o suggerimenti ci concedi il diritto di utilizzarli per fini promozionali.

Ci riserviamo il diritto di correggere errori su descrizioni, prezzi o disponibilità e di annullare ordini con rimborso integrale.

OPULENTUM non è responsabile per danni indiretti o consequenziali derivanti dall'uso dei Servizi o da ritardi logistici di corrieri terzi.

SEZIONE 18 — INDENNIZZO

Accetti di tenere indenne OPULENTUM da rivendicazioni di terze parti derivanti dalla tua violazione dei presenti Termini.

SEZIONE 19 — SEPARABILITÀ

Se una disposizione è ritenuta inapplicabile, le restanti rimangono valide.

SEZIONE 20 — INTERO ACCORDO

I presenti Termini costituiscono l'intero accordo tra te e OPULENTUM.

Ci riserviamo il diritto di cedere i nostri diritti e obblighi senza preavviso.

I presenti Termini sono disciplinati dalla legge italiana. Per controversie con consumatori, il foro competente è quello di residenza o domicilio del consumatore.
